On Thursday, the International Criminal Court, or ICC, issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and his former Chief of Defense Yoav Gallant as well as a Hamas military commander who is believed to be dead. The warrants state that Netanyahu and Gallant were criminally responsible for “acts including murder, persecution and starvation as a weapon of war as part of a widespread and systematic attack against the civilian population of Gaza.” As a result, all 124 countries that form part of the ICC are obligated to arrest the two criminals if they travel to those countries. However, the ICC does not have enforcement powers, and relies on the cooperation of members states to arrest and surrender the criminals. The United States is not a member of the ICC, primarily due to concerns that U.S. citizens, such as military officials, could be prosecuted. In 2020, the Trump administration issued economic sanctions against the ICC due to its investigation of US war crimes in Afghanistan.
